Originalism and porn
Porn is not free speech
I posted this on Facebook last week:
If you are an originalist - meaning that you think the Constitution should be interpreted as it was understood when it was written - the idea that the First Amendment protects distributing video of people having sex is laughable. This is especially true when the video shows people engaging in the most depraved sex acts imaginable.
The men who wrote and passed the First Amendment would never have said it protects hardcore pornography. Neither should we.
